As-Applied Challenge to SORNA Rejected
U.S. v. Carel, -- F.3d --, 2011 WL 6880674 (10th Cir. 12/30/11) (CO) - the Tenth rejects Mr. Carel's as-applied challenge to the constitutionality of the SORNA registration requirement. Congress has ample authority to criminalize sexual abuse of a minor in Indian country. Because the SORNA registration statute is rationally related to the effectuation of the criminal statute, Congress was empowered to enact it by the Necessary and Proper Clause.
